
During a daily press briefing, a spokesperson for the European Commission stated that they will “naturally cooperate” with Belgian authorities should they reach out.
Reynders, who will retain functional immunity even after he steps down as a European Commissioner on December 1, has this protection due to his official role. The spokesperson elaborated that former EU Commissioners are immune for actions taken while in office.
However, if former Commissioners fail to meet their ongoing obligations, as outlined in the Treaty on the European Union, the European Commission or the EU member states may bring the issue before the European Court of Justice. The spokesperson noted that the court has the authority to make decisions that could, for instance, impact the pensions of former Commissioners, though they refrained from commenting on this particular situation.
