Récupérer les superprofits de TotalEnergies : oui, mais comment ?

Dans son analyse, l’IPP attribue la faible récolte de la taxe sur les profits pétroliers de 2022 à un périmètre d’entreprises concernées plus restreint que prévu ainsi qu’à la possibilité pour les compagnies d’imputer leurs pertes des années antérieures. L’IPP estime que “quelques dizaines d’entreprises représentant 72% des superprofits” ont été épargnées.

C’est pour cette raison que, dans la proposition de loi récemment déposée, la députée Ecologiste Eva Sas propose d’élargir le périmètre, de modifier la base d’imposition et d’augmenter le taux de taxation. “On peut apprendre des leçons de 2022 pour éviter un coup d’épée dans l’eau”, pense Bastien Gebel de Transport & Environment.

Des ONG proposent une autre approche appelée “taxe unitaire”, se basant sur les travaux de l’Observatoire international de la fiscalité dirigé par l’économiste Gabriel Zucman, qui a récemment publié une étude affirmant que la proportion de profits déclarés par les géants pétroliers dans les paradis fiscaux augmente en période de crise.

“L’idée est de taxer selon l’activité réelle des entreprises pétrogazières en France”, poursuit Bastien Gebel, sans recourir à l’extraterritorialité fiscale.

Oxfam France estime que les impôts payés par TotalEnergies en France ne reflètent pas son activité réelle dans le pays, 22,8% de son chiffre d’affaires mondial étant généré en France. L’ONG évalue à 2 milliards d’euros la somme récupérable par l’Etat rien qu’en taxant TotalEnergies.

Dans sa note, l’IPP indique que la France est “un grand pays de consommation, d’emploi et d’actifs tangibles dans la chaîne de valeur de TotalEnergies, mais un nain en termes de profitabilité relative et donc en termes d’impôt”. Cela s’expliquerait par le fait que “les groupes pétroliers font de la France, et non de ses voisins, un centre de coûts plutôt que de profits”.
