A spokesperson for the European Commission stated, “Musk has the right to voice his personal and political views, but platforms must adhere to legal standards,” in reference to the Digital Services Act (DSA).
The Commission refrained from commenting on the livestream itself, noting, “The DSA does not prevent platform owners from hosting a livestream and sharing their opinions. However, we will assess the potential systemic risks associated with such a livestream.” This includes concerns about disproportionately promoting the livestream. The Commission initiated an investigation into X in December 2023 regarding compliance with the DSA. Previously, it had raised concerns about content moderation on the platform in anticipation of the upcoming European elections.
