Denmark Could Be Close to Winning the Fehmarn Belt State Aid Case

Denmark appears to be making progress in its legal battle over the Femern Belt project. The Advocate General of the EU Court of Justice expressed support for Denmark regarding state aid for the fixed connection on Thursday.

This case emerged after Denmark provided financial assistance to the company managing the connection through capital injections, state loans, and guarantees.

In 2020, the EU Commission determined that this constituted state aid but also stated that it was compatible with the internal market. Denmark subsequently sought to have the assertion of state aid annulled.

The court initially dismissed this request in 2024, prompting an appeal to the EU Court. In a draft ruling, the Advocate General recommends that the court uphold Denmark’s appeal and annul the Commission’s decision on the state aid.

While the draft ruling is not definitive, it is typically followed by the court.
