On Monday, the Pentagon announced that it is investigating Senator Mark Kelly (D-Arizona) following his participation in a video alongside other lawmakers, which called upon U.S. military service members to resist unlawful orders. This investigation is based on “serious allegations of misconduct” reported to the Department of Defence. According to Pentagon officials, the inquiry could result in recall to active service and court martial under the Uniform Code of Military Justice (UCMJ) or administrative sanctions.

As reported by Ed O’Keefe of CNN, the Pentagon’s statement stressed the legal obligation of all military personnel to obey lawful orders and noted that personal philosophy does not justify disobedience of a lawful order. The statement particularly emphasised that military retirees such as Kelly remain subject to military law and can be recalled to face charges if warranted.

Details on the Video and Allegations

The contentious video, released last week, featured six lawmakers with military or intelligence backgrounds, including Senator Kelly. The legislators urged military personnel directly to reject unlawful or illegal orders and encouraged them to uphold the Constitution and the rule of law. Kelly specifically told troops, “You can refuse illegal orders.”

According to reports from the Washington Post by Dan Lamothe, while the video did not specify which orders were illegal, it reflected ongoing bipartisan concerns about certain military operations, such as interdiction against drug traffickers in the Caribbean and deployment of military forces in domestic cities, which have drawn criticism from some state governors.

The Pentagon’s move to investigate a sitting senator is highly unusual, especially as it threatens active recall for court martial. Typically, the Pentagon avoids entangling itself directly in political controversies involving members of Congress. However, Kelly’s previous military rank as a Navy captain legally enables his recall to active duty.

As reported by Olivia Beavers of The Hill, this development also follows intense public pressure from former President Donald Trump, who labelled the video’s message as “seditious” and accused Kelly and other Democrats of actions “punishable by death.” Trump’s comments have intensified the political tensions surrounding this issue, with Kelly responding on CBS’s Face the Nation, stating he will not be intimidated by such threats.

The Pentagon’s statement, shared on social platforms and reported by Conrad Wilson of Fox News, referenced U.S. Code provisions (notably 18 U.S.C. 2387) prohibiting actions that interfere with military loyalty, morale, or discipline. It reiterated that orders are presumed lawful and reminded that disobedience of lawful orders is not excusable based on individual beliefs.

The Defence Department said the review is ongoing and further information would be limited to preserve the integrity of the process. However, it clearly indicated potential consequences include recall to service and court martial proceedings to address the alleged violations.
