Brussels Initiates Action Against Portugal for Noncompliance with Fruit, Vegetable, and Seed Regulations

The European Commission has initiated two infringement proceedings against Portugal for not properly implementing EU legislation concerning new types of fruits and vegetables and the marketing of seeds.

In relation to the incomplete transposition of Directive (EU) 2024/2963, the Commission has sent a notification letter mandating Portugal to align its national legislation with EU standards on the admission of new agricultural and horticultural plant varieties, as per the protocols set by the Community Plant Variety Office (CPVO), within two months.

Additionally, under Directive (EU) 2024/3010, Portugal is required to notify Brussels within the same two-month period about its compliance with EU legislation regarding the marketing of seeds, propagation materials, and plants, as outlined by EU phytosanitary regulations.

Failure to provide satisfactory responses in both instances may lead Brussels to escalate the infringement process to the next stage, which involves issuing a reasoned opinion.
