The new European Union packaging regulation, effective 12 August, introduces immediate chemical safety and compliance duties, advancing a transition to more recyclable, reusable, and less wasteful packaging. Businesses now face documentation requirements, and food-contact packaging containing PFAS above specific limits is banned from the EU market.
The Packaging and Packaging Waste Regulation replaces a previous directive with EU-wide applicability, covering the entire packaging lifecycle. Beyond consumer-facing items, it applies to various packaging types like transport, e-commerce, and industrial packaging.
From 12 August, manufacturers must ensure packaging compliance, prepare technical documentation, and issue EU conformity declarations, while importers and distributors face verification duties. Responsibility allocation is crucial due to the packaging’s journey through multiple entities before retail.
PFAS limits apply immediately, with packaging intended for food contact banned if containing PFAS at or above specified concentrations. While existing stock can remain in the market, items placed after the deadline must comply.
Testing for PFAS remains challenging, with no unified EU testing method, potentially leading to uneven enforcement. Coordinated national efforts are essential for consistency and avoiding undue consumer evidential burdens.
Full regulation implementation is staggered, with many key requirements due closer to 2030. Consumers won’t see immediate shelf changes; transformations will unfold gradually through updates in technical files, supplier declarations, and material policies.
Small businesses face nuanced responsibilities, with some exemptions, but without a blanket exemption. Cross-border sellers may encounter complexities due to national producer-responsibility systems.
The regulation aims to shift packaging economics, promoting design considerations like weight, hazardous substances, and end-of-life processing. Success depends on consistent enforcement, laboratory access, clear guidance, and support for smaller companies.
The regulation’s immediate impact is foundational, emphasizing upstream responsibility and chemical safety in packaging conformity, with the long-term effectiveness reliant on ongoing enforcement quality.
