
Brussels/Ljubljana – The European Commission has sent a letter to Slovenia’s Directorate for Energy, warning about the ongoing dispute between the government and the Energy Agency regarding the new methodology for calculating network charges. The Commission highlighted the importance of adhering to EU legislation that ensures the independence of regulatory bodies. If the government were to take actions undermining the Energy Agency’s independence, the Commission may initiate infringement proceedings in accordance with EU law.
In October 2024, the Energy Agency implemented a new network charge calculation methodology that prioritizes power calculation over energy flow, resulting in higher bills for certain business and household consumers.
In response, the government requested the agency to revert to the previous system by January 8, a demand the agency did not comply with. In December 2024, the government called for the resignation of certain agency board members, leading to the departure of two members. Although the government proposed the dismissal of the remaining three members last week, this did not occur during the Thursday session following the receipt of the Commission’s letter, with the government stating it would “take its time.”
In December 2024 and again in January, the Energy Agency communicated with the European Commission about the situation surrounding the new network charge calculation methodology in Slovenia and reported on attempts to interfere with the regulator’s independence. In a response to the agency on Tuesday, the European Commission reaffirmed that EU legislation concerning regulatory bodies is explicit and mandates strict rules to maintain their independence.
Furthermore, the leadership of the European Agency for the Cooperation of Energy Regulators (ACER) has reached out to the European Commission, expressing concern over the independence of the Energy Agency. ACER reiterated that the new methodology aligns with their principles and guidelines. (January 15 and 16)
