
Brussels (Eurotoday) – The European Union Court of Justice on March 6, 2025, sanctioned five nations for failing to enact laws that enhance protections for whistleblowers who expose fraud, tax evasion, data breaches, and other illegal activities.
The court imposed a fine of 34 million euros on Germany, while the Czech Republic was ordered to pay 2.3 million euros and Hungary 1.75 million euros. Estonia and Luxembourg collectively received fines totaling 500,000 euros.
The European Commission petitioned the Court of Justice to rule that Luxembourg, Germany, the Czech Republic, Hungary, and Estonia had failed to meet their obligations under the Whistleblower Directive by not implementing the necessary legal provisions. It also requested financial penalties in the form of lump sums for these member states.
According to a statement from the CJEU:
“Emphasising the importance of the transposition of that directive in view of the high level of protection it affords to whistleblowers who report a breach of EU law, the Court upholds the Commission’s actions, rejecting the arguments put forward by the Member States concerned, and imposes on them the financial penalties set out in the table below.”
What is the EU Whistleblower Directive and why is it important?
A consensus among EU member states in 2019 introduced EU-wide regulations requiring companies to establish internal reporting channels for whistleblowers and protect them from retaliation, including dismissal, demotion, or legal action. The legislation was proposed by the European Commission to standardize whistleblower protections across the EU.
Currently, whistleblower protection is managed by national authorities in the 28 EU countries, leading to significant disparities in implementation, with some countries lacking regulations entirely.
According to the European Commission, individuals who obtain information through work-related activities and report violations (‘whistleblowers’) play a crucial role in national and EU enforcement systems, helping to prevent and address breaches of EU law.
“Providing whistleblowers with strong protection against retaliation is essential to encourage reporting and strengthen the effectiveness of EU law. Giving whistleblowers this protection is also key for safeguarding their freedom of expression, enshrined in Article 11 of the Charter of Fundamental Rights of the European Union,” the Commission stated.
