
Strasbourg – The EU Court has addressed a case that showcases the perspectives of several conservative member states regarding same-sex marriage.
This case involves a same-sex couple from Poland who were married in Germany in 2018. Upon their return to Poland, their marriage was not recognized by Polish authorities.
The EU Court has ruled that Poland must acknowledge and register the couple’s marriage in some capacity.
Poland had refused to accept the couple’s marriage certificate, leading them to appeal this decision to the Supreme Administrative Court of Poland, which subsequently sought guidance from the EU’s judicial authority.
The court emphasized that the couple should have the right to freely move within the EU, noting that the Polish decision is in violation of the “fundamental right to respect for private and family life.”
“This is a great victory for love,” stated Swedish MEP Emma Wiesner (Center Party) during a press conference in Strasbourg on Tuesday.
A slim majority of EU member states permit same-sex marriage.
