Morawiecki: Court of Justice of the European Union’s Ruling is a Bold Interference in Family Law порядкe

Mateusz Morawiecki (Law and Justice) described the recent ruling by the Court of Justice of the European Union regarding same-sex marriages as a “shameless, brazen interference in the legal framework of family law within EU member states.”

He emphasized that Poland cannot accept this interference and will not be a puppet of the Court of Justice of the European Union.

The Court of Justice of the European Union (CJEU) declared at the end of November that a member state must recognize the marriage of a same-sex couple legally established in another EU country, even if the member state’s own laws do not recognize such unions.

At a press conference on Monday, Morawiecki stated that the CJEU’s ruling significantly intrudes into the domestic matters of EU member states and is vital for the stability of Polish families.

“It mandates member states to recognize same-sex marriages performed in another member country. This is comparable to a situation where, if drugs were legalized in certain EU countries, Poland would also have to accept drug imports from those countries, like the Netherlands,” he remarked.

He further asserted that “there can be no agreement to this on our part, as sovereignty is an essential principle for the operation of member states.” “The European Union should focus on critical issues such as competitiveness and addressing challenges related to the Green Deal and the migration pact. Instead, we are confronted with a blatant and inappropriate interference in the legal systems and family law of the member states,” concluded the Law and Justice politician. (1.12.2025)
