
Brussels – Marine Le Pen, currently leading the polls for the 2027 French presidential elections with 36% of voting intentions, has been officially barred from the race due to a conviction for embezzlement related to her political party, Rassemblement National.
The Decision So Far
On March 31, 2025, Marine Le Pen, leader of the far-right Rassemblement National (RN), was found guilty of misusing European Parliament funds that were intended to remunerate parliamentary assistants between 2004 and 2016. The investigation concluded that these funds were instead used to support domestic political efforts of RN, in violation of EU regulations.
As a result, Le Pen was sentenced to four years in prison, with two years to be served under house arrest. She also received a €100,000 fine and, most critically, was banned from holding any public office for five years. This disqualification takes immediate effect and overrides any future appeals, due to the application of a “provisional execution” clause—an unusual legal provision allowing the enforcement of a sentence before final judicial confirmation.
The ruling also implicated 24 other RN officials, including prominent figures such as Louis Aliot, the mayor of Perpignan. However, not all sentences carried the same weight—Aliot, while declared ineligible, remains active in politics pending his appeal.
Controversy of the Decision
The ruling arrives at a highly volatile moment in French politics. Recent JDD polls showed Marine Le Pen polling at a record 36%, far ahead of her nearest rival, former Prime Minister Edouard Philippe, who stands at 25%. In light of her popularity, the court’s decision is perceived by many as politically charged.
While the court justified its use of the rare legal clause by citing potential “disruption to democratic order” if Le Pen were to be allowed to participate, this explanation has not silenced critics. Surprisingly, dissent came even from the far-left, with Jean-Luc Mélenchon and members of La France Insoumise condemning the preemptive disqualification as harmful to democratic integrity. Their argument is simple: defeating the far-right should happen through political debate and elections, not judicial action.
The controversy intensified after a comment made by prosecutor Louise Neython gained attention. Referring to a contract linked to former RN vice president Jean-François Jalkh, Neython admitted during the trial: “I cannot ask for a relaxe [acquittal]. It would hurt me too much.” The highly unprofessional remark was criticized in legal and political circles, most notably by lawyer Alain Jakubowicz who called it “scandalous” and a threat to public confidence in judicial impartiality.
A Familiar Story? Not Quite
The case draws natural parallels to the 2017 scandal involving François Fillon, who also faced accusations of public fund misuse. However, there is a key distinction: Fillon was allowed to run his campaign and ultimately lost at the polls, whereas Le Pen has been barred from even appearing on the ballot.
Following the ruling, Le Pen addressed the media in a 20-minute press conference where she issued a warning: “Those who rejoice in this decision should not rejoice too quickly. Today the system is unjustly used against us [RN], tomorrow it will be unjustly used against them.”
