Une incertitude juridique plane sur éligibilité de Marine Le Pen pour 2027

La possibilité pour Marine Le Pen de se présenter à l’élection présidentielle de 2027 reste floue, en raison d’un débat juridique complexe alimenté ces derniers jours par une enquête du Canard enchaîné.

La question centrale : un éventuel pourvoi en cassation a-t-il pour effet de suspendre l’exécution immédiate d’une décision d’inéligibilité émise en première instance mais non retenue en appel ? Selon Le Canard enchaîné, le dépôt d’un tel recours pourrait faire resurgir la décision de première instance, rendant ainsi immédiatement effective l’inéligibilité de la cheffe de file du Rassemblement national.

Ce point de vue ne fait toutefois pas l’unanimité. L’avocat de Marine Le Pen a réfuté cette interprétation mardi sur la chaîne CNews, affirmant que le recours en cassation aurait justement un effet suspensif.

Interrogé par POLITICO, le professeur de droit pénal Didier Rebut se montre lui aussi circonspect. D’après lui, la jurisprudence évoquée par l’hebdomadaire satirique ne s’appliquerait pas clairement au cas présent. “On est un peu dans le brouillard”, admet-il.

En définitive, un seul scénario juridique permettrait actuellement à Marine Le Pen d’être assurée de rester candidate : que la cour d’appel rende une décision en sa faveur — annulant toute inéligibilité — et qu’aucune des parties ne saisisse ensuite la Cour de cassation.
